The Declarations by the seller form, for a transparent transaction

A real estate transaction includes obligations and responsibilities for all the parties involved, whether you are a buyer or a seller, represented or not by a real estate broker.

One of them is the responsibility of the seller of a property to declare everything he knows about his property to enable a buyer to make an informed decision. Therefore, the seller's broker assists his client in filling out the mandatory Declarations by the seller of the immovable (PDF) form.

This form is a kind of a report card on a property and contains details on its construction and current condition. It is part of the broker's brokerage contract and must be given to any interested buyer and to the buyer's building inspector. Where appropriate, incidents sustained by the property, such as water damage or infiltration, soil or structural problems, are recorded therein. This enables the seller to indicate how these problems have been remedied and to reassure potential buyers.

Furthermore, a seller who has not lived in the property, for example in the case of a succession, must complete the form to the best of his knowledge and specify why he cannot answer certain questions.

The seller's broker exercises his advisory role to support his client and help him formulate the answers properly, with utmost  transparency and honesty. This declaration is essential to protect both the seller and the potential buyer.
