NOTICE OF SUSPENSION OF
LISE DESMARAIS’S LICENCE (A2372)

Be advised that the Court of Québec confirmed the decision of the Discipline Committee that ordered the suspension of Mrs. Lise Desmarais, whose establishment was located in Sherbrooke, to be served whenever she will become a licence holder again, for committing the following offences:

Count 1: Concerning an immovable, acted to the detriment of the seller’s interests:

a) on or before May 11, 2016, while she was bound to said seller with a brokerage contract indicating a selling price of $399,000, by asking her if she was willing to accept a selling price of $300,000; and/or

b) on or before May 11, 2016, following the consent of said seller to accept a selling price of $300,000, by immediately offering to buy the said immovable at that price; and/or

c) on or about May 12, 2016, by having the following documents signed concomitantly with the presentation of the promise to purchase, including the Amendments form terminating the brokerage contract and the notice of disclosure; and/or

d) on or about May 12, 2016, by providing a 36-minute acceptance period for the promise to purchase; and/or

e) on or about May 16, 2016, following the refusal of the defendant’s financing for the said immovable, by referring the said seller to her spouse, real estate broker, to represent her in the brokerage contract, in order to find a tenant so that the defendant can easily obtain the financing required for the acquisition of the immovable.

Count 3: On or about May 12, 2016, concerning an immovable, indicated in the promise to purchase a) that the offered price was $375,000 and b) a deposit of $75,000 would be remitted by cheque to the seller, while this did not reflect reality;

Count 5: On or about September 16, 2016, concerning an immovable, informed the seller that she still wants to purchase the immovable on condition that the latter withdraws her request for assistance with the OACIQ.

On November 9, 2017, the Discipline Committee ordered the suspension of Lise Desmarais’s licence No. A2372 for a period of 150 days, effective December 14, 2017.
