NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON STÉPHANE GERVAIS’ LICENCE

NOTICE is hereby given that Stéphane Gervais, residential real estate broker, licence number H9781, whose establishment is located in Drummondville has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2) of the Real Estate Brokerage Act.

On February 9, 2023, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Gervais’ licence:
 
  1. Within six (6) months of his licence issuance, he shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other training deemed equivalent by the OACIQ.
 
  1. Within 30 days of his licence issuance, the applicant shall send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph (a).
 
  1. For 36 months following his licence issuance, he will be prohibited from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.
 
  1. For 36 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he will carry on his activities to the effect that the latter holds in trust the GST/QST payable to him in the course of his real estate brokerage activities, until he is required to remit them along with his tax return.
 
  1. Up to 36 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his remuneration to pay his taxes, until he is required to remit it upon presentation of his notices of assessment, or in order to make instalment payments.
 
  1. A copy of the agreement mentioned in paragraphs (d) and (e) shall be sent to the OACIQ Registry Service within thirty (30) days of his licence issuance.
 
  1. Within 30 days of his licence issuance, the applicant shall send the Organization’s Registry Service an undertaking from his agency executive officer by which the executive officer or an experienced broker undertakes to revise his real estate brokerage forms for the 12 months following his licence issuance.  
 
  1. In the event of any agency change during the period mentioned in paragraphs (d), (e) and (g), the applicant must enter into an new agreement or undertaking under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
 
  1. The periods referred to in paragraphs (c), (d), (e) and (g) shall end only upon the completion of such periods with an active real estate broker's licence.
 
  1. The periods referred to in paragraphs (c), (d), (e) and (g) shall be suspended in the event the applicant suspends or revokes his real estate broker's licence.
 
  1. The applicant shall send proof of registration for the support service offered by Revenu Québec to the OACIQ Registry Service within 30 days of his licence issuance.
     
This notice became enforceable on March 8, 2023.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
