NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON MURIELLE DE LAUNIÈRE’S LICENCE

NOTICE is hereby given that Murielle De Launière, real estate broker (licence G4707), whose establishment is located in Trois-Rivières, has had conditions and restrictions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On January 26, 2023, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Murielle De Launière:
 
  1. Within six (6) months of notification of this decision, she must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Training Department or any equivalent training accredited by the OACIQ.
  1. Within 30 days of notification of this decision, the licensee shall send the OACIQ Registry Service proof of her registration for the training mentioned in paragraph (a).
  1. As of the notification of this decision until 24 months following her discharge from bankruptcy, the licensee shall be prohibited from carrying on activities on her own account and from being designated as agency executive officer and/or from acting as one.
  1. As of the notification of this decision until 24 months following her discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter holds in trust the GST and QST payable to her, as a real estate broker, until she is required to remit them along with her tax return.
  1. As of the notification of this decision until 24 months following her discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter holds in trust a minimum of 30% of her remuneration to pay her taxes, until she is required to remit it, upon presentation of her notices of assessment, or in order to make instalment payments.
  1. A copy of the agreement mentioned in paragraphs (d) and (e) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.
  1. In the event of any agency change during the period mentioned in paragraphs (d) and (e), the licensee must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
  1. The licensee shall forward any documents filed in her bankruptcy record to the Organization's Registry Service no later than 30 days following the date of filing.
  1. The licensee shall send proof of her new GST/QST numbers to the OACIQ Registry Service within 30 days following notification of this decision.
  1. Should the licensee not be discharged from her bankruptcy by November 29, 2024, her file will be resubmitted to the Committee.
 
If Ms. Murielle De Launière fails to comply with the conditions and restrictions imposed, her right to engage in real estate brokerage activities shall be suspended until she does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

The decision became enforceable on February  17, 2023.
