NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON JOHNATHAN CLOUTIER’S LICENCE

NOTICE is hereby given that Johnathan Cloutier, full-service real estate broker (licence C4711), whose establishment is located in Blainville has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (1 and 2) of the Real Estate Brokerage Act.
On December 8, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Johnathan Cloutier:
a) Within six (6) months of his licence issuance, he shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other training deemed equivalent by the OACIQ.
b) Within 30 days of notification of this decision, the applicant shall send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph a).
c) From his licence issuance until 36 months following his discharge from bankruptcy, he will be prohibited from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.
d) From his licence issuance until 36 months following his discharge from bankruptcy, the applicant shall enter into and maintain a written agreement with the agency within which he will carry on his activities to the effect that the latter holds in trust the GST/QST payable to him, as a real estate broker, until he is required to remit them along with his tax return.
e) From his licence issuance until 36 months following his discharge from bankruptcy, the applicant shall enter into and maintain a written agreement with the agency within which he will carry on his activities the effect that the latter holds in trust a minimum of 20% of his remuneration to pay his taxes, until he is required to remit it, upon presentation of his notices of assessment.
f) A copy of the agreement mentioned in paragraphs d) and e) shall be sent to the OACIQ Registry Service within thirty (30) days of his licence issuance.
g) In the event of any agency change during the period mentioned in paragraphs d) and e), the applicant must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
h) The applicant shall forward any documents filed in his bankruptcy record to the Organization's Registry Service no later than 30 days following the date of filing, including his certificate of discharge.
i) Should the applicant not be discharged from his bankruptcy by June 16, 2024, his file will be resubmitted to the Committee.
Should the applicant fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.
This notice became enforceable on January 17, 2023.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
