NOTICE OF SUSPENSION
OF THE LICENCE OF MR. MIKE ALI POOR

NOTICE is hereby given that Mike Ali Poor, former real estate broker (Licence No. D1329), whose establishment was located in Dollard-des-Ormeaux, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:
3rd count: On or about May 5th, 2006, concerning an immovable, has participated in a stratagem in order to allow a prospective buyer to obtain a mortgage financing based on false pretenses, namely by participating in the fabrication of a false “gift letter”, the whole contrary to section 13 of the Rules of professional ethics of the ACAIQ.
4th count: Between on or about October 5, 2006 and on or about the end of May 2006, concerning an immovable, did participate in the preparation of a notice of disclosure bearing a false date of signature, the whole contrary to section 13 of the Rules of professional ethics of the ACAIQ.
5th count: On or about May 16th, 2008, concerning an immovable, has misrepresented the information he provided during an inquiry conducted by an assistant syndic, namely:
a) by falsely representing that he had filled out a notice of disclosure before a prospective buyer had made a promise to Purchase;
b) by providing to assistant syndic a notice of disclosure bearing a false date of signature;
committing for every and each of the above paragraphs, an offence to section 55 of the Rules of professional ethics of the ACAIQ.
6th a) count: Concerning an immovable, has signed on behalf of a vendor without having previously obtained a written document establishing that he had the authorization to do so on or about April 13th, 2005, an exclusive brokerage contract, the whole contrary to section 13 of the Rules of professional ethics of the ACAIQ.
7th count: Concerning an immovable, has misrepresented the information and/or concealed information provided during an inquiry conducted by an assistant syndic, namely;
a) on or about May 16th, 2008, by falsely representing that he had power of attorney to represent a vendor;
b) on or about the end of June 2008, by providing to assistant syndic a document allegedly giving him the “power of attorney” (sic) from a vendor, after he had striken off some information;
committing for every and each of the above paragraphs, an offence to section 55 of the Rules of professional ethics of the ACAIQ.
9th count: On or about April 10th, 2006, concerning an immovable, has striked off or let someone striked off his name written in section 2.1 of a promise to purchase after the parties had signed at the bottom of the said form, the whole contrary to section 98 of the By-law of the ACAIQ.
10th count: On or about June 1st, 2006 concerning an immovable, to have participated in a stratagem in order to allow a prospective buyer to obtain a mortgage financing based on false pretenses, namely by participating in the fabrication of a false “employment letter”, the whole contrary to section 13 of the Rules of professional ethics of the ACAIQ.
13th count: Concerning an immovable, has obtained directly from prospective buyers, in order to obtain the sum of:
a) on or about March 5th, 2007, the sum of one thousand dollars ($1000.00);
b) on or about March 19th, 2007, the sum of three thousand dollars ($3000.00);
as compensation from a person other than the holder of a chartered real estate broker’s certificate that employed him or authorized him to act on his behalf;
committing for every and each of the above paragraphs an offence to section 72 of the By-law of the ACAIQ.
On February 12, 2013, the Court of Québec rejected Mike Ali Poor’s appeal and confirmed the decision of the Discipline Committee dated December 20, 2011 ordering a suspension of Mike Ali Poor’s licence (D1329) for a period of three (3) years, ten (10) months and one hundred and sixty-five (165) days, to be served whenever he becomes a licence holder again.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
