NOTICE OF SUSPENSION
OF MS. MARIE-JOSÉE LACELLE’S LICENCE

NOTICE is hereby given that Ms. Marie-Josée Lacelle, former real estate broker (licence no. E2239), whose establishment was located in Montréal, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:
2nd count: On or around April 6, 2010, concerning an immovable, drafted and had someone sign a promise to purchase and its annexes as well as a counter – proposal, which did not contain any reference to the Amendments and notice of fulfilment of conditions form, already signed by the seller, thus allowing buyers to obtain mortgage financing on the basis of false information, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.
3rd count: Concerning an immovable, affixed her signature and initials as witness to those of the following parties, whereas she was not present when the documents were signed, namely:
a) on or around March 29, 2010, on the Amendments and notice of fulfilment of conditions form, for the promising buyers;
b) on or around April 6, 2010, on the Promise to purchase and its annexes for sellers;
c) on or around April 6, 2010, on the Counter – proposal, for sellers;
d) on or around April 7, 2010, on Annex A, for buyers;
e) on or around April 7, 2010, on the Counter – proposal, for sellers;
committing, on each of these occasions, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.
4th count: Between on or around March 29, 2010 and on or around April 7, 2010, concerning an immovable, did not send without delay the information and documents required for keeping records, books and registers to the Manager of the establishment to which she was assigned, including:
f) the Amendments and notice of fulfilment of conditions form;
thus committing an offence under section 147 of the By-Laws of the Association des courtiers et agents immobiliers du Québec;
On February 10, 2014, the Discipline Committee ordered a suspension of Ms. Marie-Josée Lacelle’s real estate broker’s licence (licence no. E2239) for a period of ninety (90) days on each of the counts no. 2 and 3a) to 3e) of the formal complaint, to be served concurrently with each other, and a suspension for a period of thirty (30) days on count no. 4 f) of the formal complaint, to be served consecutively to the suspension periods ordered on counts no. 2 and 3 a) to 3 e) of the formal complaint, for a total suspension period of one hundred and twenty (120) days.
Given that Ms. Marie-Josée Lacelle is no longer a licence holder, her licence will be suspended whenever she becomes a licence holder again.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
