NOTICE OF SUSPENSION OF
JOSEPH LUBAIN’S LICENCE (A9035)

Be advised that on May 23, 2023, the OACIQ Discipline Committee ordered that the commercial and residential real estate broker licence of Mr. Joseph Lubain, whose establishment was located in Laval, be suspended for a period of 90 days whenever he becomes a licence holder again, for committing the following offences:

Count 1: Concerning an immovable located in Montreal, did not obtain the signatures of all sellers on the following documents:
  1. On or about March 11, 2019, on the brokerage contract;
  2. On or about March 11, 2019, on the Declarations by the seller of the immovable form;
  3. On or about May 17, 2019, on a promise to purchase;
  4. On or about May 19, 2019, on a promise to purchase.
Count 2: On or about May 11, 2019, concerning an immovable located in Montreal, in the course of the performance of a brokerage contract, told a real estate broker that the said immovable was sold, while this was not the reality.

Count 4: Concerning an immovable located in Montreal, did not send the following documents to the agency he was acting for:
  1. As of March 11, 2019, a copy of the leases;
  2. As of April 25, 2019, all refused and/or unanswered promises to purchase;
  3.  As of May 13, 2019, a promise to purchase.
